OVERVIEW

This website is operated by PokeVault Smash Pack and Sports Trading Card Shop LLC, trading as PokeVault Smash Pack. Throughout this website, “we,” “us,” and “our” refer to that business.

We provide this website, its content, and our products and services subject to these Terms of Service and the policies referenced below. Our store is powered by Shopify.

By using our website or placing an order, you agree to these Terms to the extent permitted by applicable law. Nothing in these Terms limits mandatory consumer rights.

SECTION 1 – ACCOUNT AND CUSTOMER INFORMATION

You must be legally able to enter into a purchase agreement or have the permission and supervision of a parent or legal guardian who is responsible for the purchase.

You agree to provide accurate and current contact, billing, payment, and shipping information. You must be authorized to use the payment method submitted.

You are responsible for protecting your account credentials and notifying us promptly of suspected unauthorized access. Accounts and membership benefits may not be transferred or shared unless the applicable plan expressly permits it.

SECTION 2 – PRODUCTS AND DESCRIPTIONS

We sell trading cards, sealed trading-card products, graded cards, and other merchandise described in our listings.

Review each listing before purchasing, including the product name, set, language, card number, variant, quantity, condition, grading company, grade, and any disclosed imperfections.

Product images may be stock images or photographs of the actual item. Unless a listing expressly states that the pictured item is the exact item being sold, the image is representative. The item supplied must match the material description in the listing.

Screen settings, lighting, and photography may affect how colors and finishes appear. These differences do not excuse supplying an incorrect or materially misdescribed product.

Changes to a listing after purchase do not retroactively change what you ordered.

SECTION 3 – SINGLES, CONDITION, AND GRADING

Ungraded cards are sold in the condition described in their listings. A condition designation is not a guarantee of a particular grade from any grading company.

Review available photographs and disclosed wear before buying. Contact daniel@smash-pack.com if you need clarification about a listing.

Graded cards are sold with the grading company, grade, and certification details stated in the listing. Grades reflect the grading company’s assessment. We do not guarantee that another grading company will assign the same grade or that a card will receive a higher grade upon resubmission.

Grading-company opinions, resale values, and future market prices are not guaranteed. These provisions do not limit remedies for counterfeit, incorrect, damaged, or materially misdescribed items.

SECTION 4 – SEALED PRODUCTS AND RANDOM CONTENTS

Sealed products are sold in the packaging condition described in their listings. Any known material packaging damage or seal concerns should be disclosed in the listing.

Factory-sealed products contain randomized cards where applicable. We do not guarantee specific cards, rarity levels, pull rates, card values, or grading outcomes unless a listing explicitly promises particular contents.

Manufacturer production variations can affect card centering, print quality, and packaging. Claims involving defective products will be reviewed under our Returns & Refunds policy and applicable law.

Opening a product does not create a return entitlement merely because its randomized contents are disappointing. This restriction does not override statutory cancellation rights or remedies for defective or misdescribed goods.

SECTION 5 – ORDERS AND AVAILABILITY

Orders are subject to payment verification and product availability.

An automated order acknowledgment confirms receipt of your order and does not, by itself, guarantee fulfillment. Any order acceptance or cancellation remains subject to applicable law.

We may decline or cancel an order for legitimate reasons, including unavailable inventory, suspected fraud, unauthorized payment, shipping restrictions, or a material listing or pricing error.

If we cancel a paid order, we will notify you and refund the amount paid for the canceled items and any applicable shipping charges.

We may apply purchase limits disclosed in a listing, promotion, or checkout. We will not charge you for substitutions or additional items without your agreement.

SECTION 6 – PRICES, TAXES, AND MARKET VALUES

The applicable currency, item prices, discounts, shipping charges, and taxes are shown at checkout. Review the total before submitting payment.

Prices and promotions may change for future purchases. Later market-price changes do not entitle either party to change the price of a completed purchase or obtain a refund solely because the item’s value changed.

References to market value are estimates based on the source, timing, condition, language, and variant used for comparison. They are not guarantees of resale value, investment returns, or future savings.

Unless expressly stated, discounts cannot be combined. Any specific promotion conditions will be disclosed with the offer.

SECTION 7 – PRICING AND LISTING ERRORS

We may correct typographical errors, incorrect prices, inaccurate product details, and inventory discrepancies.

If a material error affects your order, we will contact you to explain the issue. Where permitted by law, we may cancel the affected order and issue a refund or offer you the choice of proceeding on corrected terms.

We will not charge an increased price or substitute a different product without your agreement. Corrections and cancellations remain subject to applicable consumer and contract law.

SECTION 8 – SHIPPING AND INTERNATIONAL ORDERS

Orders normally ship within 3–5 business days after payment is confirmed, excluding weekends and holidays, unless a different processing period is clearly stated for the product before purchase.

Processing time is separate from carrier transit time. Faster shipping does not shorten processing time unless expressly offered.

We offer delivery to destinations supported by our checkout, shipping providers, and applicable restrictions. Availability of international ordering does not mean every product can be shipped to every destination.

Carrier delivery dates are estimates unless expressly guaranteed. Customs processing, weather, holidays, and carrier disruptions can affect delivery.

If we cannot ship within the promised processing period, we will contact you with an updated estimate and options to proceed or cancel for a refund.

For international orders, taxes, duties, and customs charges may be collected at checkout or assessed on arrival. Any amounts already collected at checkout should not be paid again for the same charge. Where charges are not prepaid, the customer is responsible for lawful import charges disclosed as their responsibility before purchase.

We will not falsify customs declarations or declare purchases as gifts.

Please contact us promptly about delayed, missing, damaged, or undelivered packages. We will help investigate and provide any remedy required by applicable law. Handing a package to a carrier does not remove our mandatory obligations to customers.

SECTION 9 – RETURNS, REFUNDS, AND CANCELLATIONS

Our voluntary return policy does not allow change-of-mind returns, accidental-purchase returns, or returns based solely on market-value changes or disappointing randomized contents.

If we ship the wrong sealed product, contact us before opening it. For a return under our voluntary shipping-error process, the product must remain unopened, unused, and undamaged, with its original packaging and seals intact. We cover the authorized return shipping when the error is ours.

Incorrect singles or graded cards, damaged or defective products, and materially misdescribed items are reviewed separately under our Returns & Refunds policy.

These restrictions do not override statutory cancellation, refund, warranty, or other consumer rights.

Where EU, EEA, UK, or other applicable law provides a cooling-off period or other cancellation entitlement, we will honor that entitlement. Contact daniel@smash-pack.com with a clear statement that you wish to cancel and enough information to identify the order. You do not need our discretionary approval to exercise a statutory cancellation right.

Any statutory return deadlines, reimbursement deadlines, shipping-cost rules, and permitted deductions apply as required by the governing law.

For other cancellation requests, contact us promptly. We may be unable to stop an order that has already been processed or shipped.

SECTION 10 – MEMBERSHIPS AND RECURRING PAYMENTS

Membership pricing, billing frequency, benefits, and any minimum commitment must be disclosed before enrollment.

Where a membership renews automatically, recurring charges require your agreement to the disclosed subscription terms. Charges continue according to those terms until cancellation takes effect.

The cancellation method and timing, access after cancellation, and any membership refund terms will be stated in the applicable membership or subscription policy. Contact daniel@smash-pack.com for assistance.

Membership benefits apply only as described for the purchased plan. Eligible products, stock availability, purchase limits, and exclusions must be disclosed. A membership does not guarantee availability of particular products, a specific amount of savings, or a profit.

Changes to recurring prices or material membership terms will be communicated in advance, with any consent and cancellation options required by law. Changes will not retroactively remove benefits already purchased.

Our product return policy does not determine statutory subscription-cancellation or refund rights.

SECTION 11 – COLLECTION PURCHASES AND BUYBACK OFFERS

Any collection-purchase or buyback service is subject to the separate offer and terms provided for that transaction.

An initial estimate is not a final purchase commitment. Final offers may depend on verification of authenticity, ownership, card identity, condition, quantity, and the agreed market-value source.

Cash and store-credit amounts, payment timing, shipping responsibility, and what happens if an offer is declined must be disclosed before a customer sends items.

Do not send a collection without receiving submission instructions. A membership does not itself guarantee acceptance of every collection or immediate payment.

SECTION 12 – INTELLECTUAL PROPERTY

Our original website content, business branding, and other materials are protected by applicable intellectual-property laws.

Third-party product names, characters, trademarks, card artwork, and grading-company marks belong to their respective owners. Their appearance on our website identifies products or services and does not imply sponsorship, endorsement, or affiliation.

You may browse and use the website for lawful shopping purposes. You may not reproduce or commercially exploit protected content without permission from the appropriate rights holder, except where permitted by law.

SECTION 13 – RELATIONSHIP WITH SHOPIFY

PokeVault - Smash Pack Sports and Trading Card Shop is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with PokeVault - Smash Pack Sports and Trading Card Shop. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and PokeVault - Smash Pack Sports and Trading Card Shop, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with PokeVault - Smash Pack Sports and Trading Card Shop.

SECTION 14 – THIRD-PARTY SERVICES AND LINKS

Our website may use third-party payment providers, membership tools, shipping services, and other services, or link to external websites.

Those providers may have separate terms and privacy policies. Review them when using their services.

We do not control independent third-party websites. This provision does not exclude our responsibility for our own promises, conduct, or mandatory obligations concerning services used to fulfill your order.

SECTION 16 – REVIEWS AND CUSTOMER SUBMISSIONS

You are responsible for ensuring that reviews, photos, and other content you submit are lawful, accurate to your experience, and do not infringe another person’s rights.

By submitting content for publication on our store, you grant us a nonexclusive, royalty-free license to display, reproduce, and format it for store operation and related promotion, subject to applicable privacy and consumer law.

Disclose any incentive or compensation connected with a review. Do not submit false reviews or impersonate another person.

We may remove unlawful content, spam, personal information, or content unrelated to the product or shopping experience. We will not suppress a review merely because it expresses an honest negative opinion.

SECTION 17 – PROHIBITED CONDUCT

You may not use our website to commit fraud, submit unauthorized payments, impersonate another person, distribute malicious software, unlawfully collect personal information, infringe intellectual-property rights, or interfere with website security.

Automated access must comply with applicable law and our technical access restrictions. You may not bypass security controls or use automated purchasing tools to evade disclosed purchase limits.

We may restrict access or suspend an account for documented misuse. Suspension does not remove our obligations concerning existing paid orders, refunds, or mandatory consumer rights.

SECTION 18 – WARRANTIES AND LIMITATIONS OF LIABILITY

We do not promise uninterrupted or error-free website operation, guaranteed card values, particular randomized contents, or future grading results.

To the extent permitted by law, we exclude implied warranties concerning website functionality and liability for indirect or consequential losses arising from website use.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including applicable rights concerning product quality, description, delivery, refunds, fraud, or personal injury.

Any limitation applies only to the extent permitted by the law governing your transaction. These Terms do not replace express promises made in a product listing or order agreement.

SECTION 19 – DISPUTES AND CUSTOMER SUPPORT

If you have a concern about an order, membership, or our website, contact daniel@smash-pack.com so we can investigate.

Include your order number, relevant details, and photographs where helpful. Never email complete payment-card details.

Contacting us does not waive your right to use lawful payment-provider dispute procedures, regulatory complaints, or court remedies. These Terms do not require mandatory arbitration or waive class-action rights.

SECTION 20 – GOVERNING LAW AND CONSUMER RIGHTS

These Terms are subject to the applicable laws governing our business and your transaction.

Where mandatory consumer laws of your country of residence apply, those protections remain available. Nothing here requires you to surrender a legally protected right to bring a claim in an appropriate court.

SECTION 21 – SEVERABILITY AND ENTIRE AGREEMENT

If a provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

These Terms, the applicable product listing, your order agreement, and the policies incorporated here form the agreement for the relevant transaction.

Failure to enforce a provision on one occasion does not automatically waive the right to enforce it later.

SECTION 22 – CHANGES TO THESE TERMS

We may update these Terms for future website use and transactions.

The terms applicable when you place an order will continue to govern that order unless a lawful change is agreed. Membership changes are subject to the notice, consent, and cancellation requirements described above.

We will provide notice of material changes where required by law.
